Terms & Conditions

Eligibility: This promotion (this “Promotion”) is open only to legal residents of, and individuals who are physically located within, the State of Arizona who are at least 18 years old at the start of the Promotion Period. Employees, officers, managers, and directors of Danzeisen Dairy and Phoenix Rising Football Club (collectively “Sponsor”), and each of their respective franchisees, parents, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the design or execution of this Promotion (collectively, the “Sponsor Released Parties”), and the members of the immediate families or households, whether or not related, may not enter this Promotion.

Promotion Period: Promotion begins at 8:00 am Pacific Daylight Time (“PT”) on June 14, 2019 and ends at 11:59 pm PT on August 13, 2019 (the “Promotion Period”).

How to Participate: During the Promotion Period, locate and purchase 1 of only 10 Danzeisen Dairy & Phoenix Rising Football Club promotional copper milk bottles (each, a “Promotional Bottle”) offered for sale at qualifying Arizona Fry’s, Albertsons, Safeway, Bashas, AJ’s Fine Foods, or Sprouts grocery stores in the Phoenix, Arizona metropolitan area (the “Qualifying Grocery Stores”)¹. Promotional Bottles will be randomly distributed by Sponsor among all Qualifying Grocery Stores. If all Promotional Bottles are not purchased, then not all Awards will be distributed.

Bottle Redemption: If you locate and purchase a Promotional Bottle, you must email store@danzeisendairy.com with the subject line “Find the Copper Bottle Treasure Hunt” along with your complete name, address (including city, state and zip code), valid email address, date of birth, and phone number (including area code), along with the location where the Promotional Bottle was found with the valid PIN Code exactly as printed on the Promotional Bottle (the “Redemption Request”), before the end of the Promotion Period in order to arrange for Promotional Bottle redemption and to be eligible to receive the Award. Each PIN code may be redeemed a maximum of one (1) time. After redemption, each PIN code is expired and may not be reused. Eligible PIN codes must be redeemed during the Promotion Period or PIN code is void. Maximum of one (1) Redemption Request per person/household in the Promotion. All Redemption Requests must be fully complete with all required information.

Promotional Award: Each eligible entrant who completes and submits a valid Redemption Request by the end of the Promotion Period will be eligible to receive one promotional award that includes the following elements (collectively, the “Award”):

Maximum of ten (10) Awards. Each Award has an approximate retail value (“ARV”) of $450. Total maximum ARV of all available Awards: $4,500. No more than the advertised number of Awards will be awarded for any reason. Maximum of one (1) Award per person/household in the Promotion. IMPORTANT: In the event of any technical or programming errors, tampering, or any error or malfunction of any kind that results in more than the scheduled number of entrants being notified they are entitled to receive an Award, then all such entrants shall be placed into a random drawing, and the number of Award recipients identified above will be randomly selected from all participants who submitted a valid Redemption Request. Promotional Bottle must be turned in at time of Award redemption. Arrangements will be made to return the Promotional Bottle to the recipient after Promotion is closed.

Promotional Award Conditions: Award recipient may be required to present a copy of a valid driver’s license, social security card or government I.D. as a condition of receiving any Award. Tickets included with Award subject to the terms and conditions and policies of the hosting venue. Date and time of game determined by Sponsor in its sole discretion. Any and all costs or expenses related to Award acceptance, delivery and use not specified herein as being included in the Award are the recipient’s sole responsibility, including but not limited to all transportation or travel costs required for redemption/use, parking, accommodations, meals and incidental expenses, gratuity, federal, state and local taxes. All Awards are non-transferable, and no cash redemption or Award substitution allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute an Award (or any element thereof) with one of comparable or greater value, at its sole discretion. All properly claimed Awards will be awarded. Any unclaimed Awards will not be awarded.

Additional Terms and Conditions: By participating, entrants agree to abide by and be bound by these Terms and Conditions and the decisions of the Sponsor, which shall be final in all matters relating to this Promotion. In the event an entrant receives an Award and is later found to be in violation of these Terms and Conditions, he/she will be required to forfeit the Award or to reimburse Sponsor for the stated value of the Award if such violation is discovered after entrant has used the Award. Participation in this Promotion constitutes permission for the Sponsor and its designees to use entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide on perpetuity without limitation or further compensation, notification or permission, unless prohibited by law. False, fraudulent or deceptive entries or acts shall render entrants ineligible for any Award. By participating, entrants agree to hold all Sponsor Released Parties and the Qualifying Grocery Stores (the “Released Parties”), harmless from any and all claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to entrant’s participation in this Promotion, or the acceptance, possession or use/misuse of any Award, or participation in Promotion-or Award-related activities (including but not limited to travel or activity related thereto), and to assume all liability there for, including, but not limited to (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Promotion; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Promotion; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or land line phone service; (f) any injury, or loss (including death) to persons or property of any kind, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or from the receipt, use or misuse of any Award(including, without limitation, attorneys’ fees, claims, costs, personal injuries, losses and damages related to personal injuries, death, damage to or destruction or property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional, under a theory of contract, tort (including negligence), warranty or other theory); and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, defamation or invasion of privacy and merchandise delivery. Released Parties shall not be liable to winner or any other person for failure to supply the Award or any part thereof by reason of any acts of God, any actions, regulations, orders, or requests by any governmental entity, equipment failure, terrorist acts, war, fire, unusually severe weather, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, or any other cause beyond Released Parties’ sole control. Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Promotion, acting in any manner deemed by Sponsor to be in violation of these Terms and Conditions, or acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor reserves the right to cancel, modify or terminate this Promotion if fraud, misconduct or technical failures destroy or threaten the integrity of this Promotion, in the opinion of the Sponsor.

This Promotion is governed by the laws of the United States and of the State of Arizona without respect to conflict of law doctrines. Unless otherwise prohibited by law, as a condition to participating in the Promotion the Award awarded by this Promotion, each entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any Awards awarded, shall be resolved individually, without resort to any form of class action, and will be determined by final and binding individual dispute resolution under the applicable rules of the American Arbitration Association; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, and in no event will entrant be entitled to received attorneys’ fees or other legal costs; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of entrant and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with the laws of the State of Arizona, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Arizona or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Arizona.
